Terms of sale and delivery

1. General

DTS GmbH (referred to hereafter as: the Seller) sells and delivers exclusively in accordance with its terms and conditions of sale and delivery, as detailed herein.

 

2. Orders

The presentation of goods in our online shop does not represent an offer. It is a non-binding invitation to customers to place orders. By ordering goods, customers make a binding offer to enter into a contract. The Seller shall immediately confirm the receipt of an order by electronic means. The receipt of an electronic order does not constitute the Seller’s binding acceptance. The Seller is entitled to accept the customer’s binding offer within three working days of receiving it. The wording of the contract will be saved by us and sent to the customer by email together with our legally effective terms and conditions.

 

3. Delivery

Ordered goods will be dispatched to the customer no later than three working days after our acceptance of the offer. If delivery is delayed, we will inform the customer immediately about the delivery date. There are no delivery restrictions.

 

4. Warranty

The warranty period for all warranty claims on the sale of used goods, with the exception of customer claims for damages, is one year from the date of delivery.

 

5. Liability

We shall not be liable for minor negligence on our own part or that of our subcontractors. This exclusion of liability shall not apply to claims based on injury to life, body or health, claims involving warranties, or claims arising under the German Product Liability Act. Nor shall it apply to slightly negligent breaches of those essential obligations without which the contract cannot be fulfilled. If essential obligations are breached through minor negligence, our liability is limited to the amount of damages typical in transactions of this kind, being those foreseeable at the time the contract was concluded or, at the latest, when the breach was committed.

 

6. Duty of care

Buyers must ensure that any changes and conversions to their vehicles, if they are to be driven on public roads, are entered in their vehicle registration documents in accordance with the statutory provisions. Buyers may have to present their vehicles to the technical inspection agency (TÜV). It is the buyer’s responsibility to register converted vehicles and their components with TÜV.

 

7. Retention of title

The Seller reserves the right of ownership of goods sold until the purchase price has been paid in full.

 

8. Terms of pricing and payment

Goods shall only be dispatched/delivered against payment in advance (advance bank transfer), PayPal, credit card or cash on collection. The Seller’s prices are final prices including VAT but exclusive of delivery fees. The delivery fees section details shipping costs.

Consumers have the right to cancel, details of which are in the cancellation rights section. If you exercise your right to cancel, it is agreed that you shall carry the direct costs of return shipping in accordance with § 357 (6) BGB n.F. (German Civil Code; new version), irrespective of the price of the item being returned. There shall be no offsetting against customer claims that are disputed or not established without further legal recourse.

 

9. Jurisdiction and choice of law

The place of jurisdiction for any disputes arising from or in connection with agreements between the Seller and business people, and between the Seller and persons whose residence or habitual abode is not within the purview of the German Code of Civil Procedure, is the Seller’s registered office. Legal relations between the Seller and the Buyer arising from or in connection with this agreement shall be governed by the law of the Federal Republic of Germany, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

All prices are final prices in euros and include statutory value added tax. There are also shipping costs, which you can find in the delivery fees section.
